  1. The Promoter

The Promoter is: Lucky Escape Competitions Limited

  1. How to enter
    • Each competition will run for a specified period. Please see each competition for details of start and end times and dates.
    • To enter a competition, you must answer a multiple-choice question. You will need to use your skill and judgement to answer the question and only correctly answered questions will be eligible to win the prize.
    • All competition entries must be received by the Promoter no later than the time and date specified in the competition description. All competition entries received after such time and date are automatically disqualified.
    • To enter the competition:
      • send a letter with the competition you would like to enter, the answer to the question and the following personal details: name; telephone number and e-mail address by post to 21 Westburn Drive, Inverurie, AB51 5QR by no later than 4pm the day before the competition closes.
      • enter the competition online by creating an online account, answering the question, paying the applicable entry fee and submitting the online entry form provided on luckyescapecompetitions.com by the time and date specified in the competition. Availability and pricing of competitions and tickets is at the discretion of the Promoter and will
        be specified at the point of sale on the website.
    • The Promoter will not accept:
      • responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
      • proof of posting or transmission as proof of receipt of entry to the competition.
    • By submitting a competition entry, you are agreeing to be bound by these terms and conditions.
  2. Eligibility
    • The competition is only open to all residents in the UK aged 18 years or over, except:
      • employees of the Promoter or its holding or subsidiary companies; and
      • employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the competition or its administration.
    • In entering the competition, you confirm that you are eligible to do so and eligible to claim the prize. The Promoter may require you to provide proof that you are eligible to enter the competition.
    • The Promoter will not accept competition entries that are:
      • automatically generated by computer;
      • completed by third parties or in bulk;
      • illegible, have been altered, reconstructed, forged or tampered with;
      • photocopies and not originals; or
    • There is a limit of twenty online entries per person and one letter entry per person. Entries on behalf of another person will not be accepted and joint submissions are not allowed.
    • Competition entries cannot be returned.
  3. The prize
    • The prize will be the holiday described in each competition.
    • The holiday is the number of people, class of transport and type of carrier, to the destination for the number of nights between the dates specified in the competition. Unless otherwise specified in the competition, the prize does not include travel insurance, the cost of transfers to and from airports or stations, food and drink, spending money, tax or personal expenses. Any other costs incurred in addition to those set out above and that are incidental to the fulfilment of the prize are the responsibility of the winner.
    • You will be responsible for ensuring that you and any person travelling with you are available to travel and hold valid passports, any necessary visas and travel documents for the holiday in question on the travel dates specified.
    • The Promoter reserves the right to offer a cash alternative to the prize no less than 70% of the value, where agreed with the winner. The Promoter reserves the right to offer the cash alternative should the ticket sales not reach the minimum requirement.
    • The prize will be supplied by a travel agent. The Promoter reserves the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond the Promoter's control makes it necessary to do so.
    • The prize is not negotiable or transferable without the consent of the Promoter.
    • In the event that ticket sales have not reached the minimum requirement to draw the competition the Promoter reserves the right to extend the competition deadline up to 4 times.
  4. Winners
    • All correctly answered questions will be eligible to win the prize. Entries with the correct answer will be entered into and the winner will be selected by using a random number generator.  The decision of the Promoter is final, and no correspondence or discussion will be entered into.
    • The Promoter will contact the winner personally as soon as practicable prior to any announcement on the Promoter’s website, Facebook or Instagram, using the telephone number or email address provided with the competition entry. The Promoter may record and show the draw live on its social media platforms.
    • The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will publish the name of prize winners and, if applicable, their winning entries and a photograph on the Promoter’s website, Facebook and Instagram pages as soon as practicable following the draw.
    • If you object to any or all of name, photograph or winning entry being published or made available, please contact the Promoter. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.
  5. Claiming the prize
    • The prize may not be claimed by a third party on your behalf.
    • The Promoter will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available within 7 days of the draw, the Promoter reserves the right to offer the prize to the next eligible entrant selected from the correct entries that were received before the competition closing date.
    • The Promoter does not accept any responsibility if you are not able to take up the prize.
  6. Limitation of liability

Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.

  1. Ownership of competition entries and intellectual property rights
    • All competition entries and any accompanying material submitted to the Promoter will become the property of the Promoter on receipt and will not be returned.
    • You agree that the Promoter may, but is not required to, make your entry available on its website and any other media, whether now known or invented in the future, and in connection with any publicity of the competition. You agree to grant the Promoter a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the competition entry, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry for such purposes.
  2. Data protection and publicity
    • The Promoter will only process your personal information as set out in the Promoter’s Privacy Policy. See also condition 3 and condition 5.4, with regard to the announcement of winners.
  3. General
    • If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition.
    • The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.
    • These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
